Do I have to declare a foreign pension in Spain?
You are entitled to spend 90 days a year in Spain with your tourist visa. However, if you wish to stay for longer periods of time, you will be required to obtain a Non-Lucrative Residency visa. This will allow you to remain in Spain for up to a year, as long as you do not partake in any economic activities. If you’re a tax resident in Spain, you must declare all worldwide income. including pensions received from other countries.
When do I become a tax resident in Spain?
The residence is attributed for full calendar years. Your  are considered a tax resident in Spain if:
– you stay more than 183 days in a calendar year, or
– you have the main core of your financial activies in Spain, or
– your family (spouse and children) live in Spain
Will I be taxed twice on my foreign pension?
Not necessarily. Spain has Double Taxation Agreements (DTA) with many countries to prevent double taxation. You can often apply deductions for tax already paid abroad. You can check if your country has signed a DTA with Spain by clicking here.
What if I have a public pension?
Government pensions are excluded from the Spanish tax base. However, if apart from that pension you have other income which is taxable in Spain, the exempt pension will be added to your income in order to calculate your tax base
What happens if I don’t declare my foreign pension?
It may lead to penalties and affect your minimum pension supplement. The Social Security office can even ask for refunds of overpaid amounts.
